Version v6
LOTTERY TICKET AGENCY SERVICES AGREEMENT By registering on the "US-Jackpot" website (the "Service"), you (the "Client") enter into an agreement with the Service operator (the "Agent"), under which the Agent provides the Client with agency services for carrying out the Client's instruction to purchase US lottery tickets (Powerball, Mega Millions). This Service is not a lottery operator and does not sell lottery tickets itself — the Agent acts as the Client's representative, carrying out the instruction to purchase a ticket from an official licensed lottery retailer. The Agent acts exclusively as the Client's representative on the basis of this instruction. All actions relating to the purchase, temporary custody, and delivery of the physical lottery ticket are performed by the Agent on behalf of, for the account of, and in the interest of the Client. The Agent is not a seller of lottery tickets, a lottery operator, a gambling operator, or an official representative of the lottery operator. 1. DEFINITIONS 1.1. Agent — the operator of the Service, which, for a fee, provides the Client with agency services for carrying out the Client's instruction to purchase, temporarily hold, and deliver lottery tickets in accordance with this Agreement. 1.2. Client — an individual who has registered on the Service and instructs the Agent to purchase a lottery ticket with a combination of numbers of their choosing. 1.3. Ticket — a physical paper lottery ticket purchased by the Agent from an official licensed lottery retailer in fulfillment of the Client's Instruction. 1.4. Instruction — the Client's direction to the Agent to purchase a Ticket with a combination of numbers determined by the Client, formed by selecting numbers and making payment on the Service. 1.5. Account — the section of the Service available to the Client after registration and login, showing their Tickets, statuses, and notifications from the Agent. 2. LEGAL STATUS OF THE AGENT 2.1. The Agent acts exclusively as an intermediary (agent) between the Client and the official licensed lottery retailer, and does not accept bets, does not organize drawings, and does not conduct any gambling operations. 2.2. The Agent is not affiliated with Powerball, Mega Millions, the Multi-State Lottery Association (MUSL), any US state lottery, or any official lottery retailer. 2.3. All trademarks of Powerball, Mega Millions, and other lotteries belong to their respective rights holders and are used on this Service for informational purposes only. 2.4. Any reference in this Agreement to the Agent "purchasing" a Ticket means the Agent carrying out the Client's Instruction by purchasing the Ticket from an official licensed lottery retailer, and not an independent commercial activity by the Agent to sell or resell lottery tickets. 3. INSTRUCTION 3.1. By selecting numbers in a ticket on the site and paying for it, the Client instructs the Agent to purchase a physical lottery ticket with exactly the same combination of numbers from an official licensed lottery retailer before the betting cutoff time for the selected drawing. 3.2. The Agent shall mark on the ticket exactly the numbers selected by the Client on the site, without any changes. 3.3. The Agent does not determine the combination of numbers and does not make any number-selection decisions on the Client's behalf. 4. OWNERSHIP OF THE TICKET 4.1. From the moment the Agent purchases the physical lottery ticket in fulfillment of the Client's Instruction, ownership of that ticket belongs to the Client. The Agent only holds it in temporary custody as the Client's representative (agent). 4.2. The Agent acquires no proprietary rights whatsoever to the purchased Ticket. 4.3. The original Ticket is not used by the Agent for its own benefit and may not be transferred to third parties, except as necessary to carry out the Client's Instruction or as required by law. 5. AGENT'S OBLIGATIONS 5.1. Purchase the ticket in time to participate in the selected drawing. 5.2. Obtain the physical Ticket from an official licensed lottery retailer. 5.3. Photograph the received ticket and upload the photo to the Client's account on the Service within a reasonable time after purchase. A photo of the physical ticket serves as confirmation that the Agent has carried out the Client's Instruction to purchase the ticket. 5.4. Carefully store the original physical ticket until the deadline set by the rules of the relevant lottery for claiming winning tickets, and, if it is a winning ticket, until it is delivered to the Client or until the prize-claim procedure is completed. 5.5. Original Tickets are stored under conditions that ensure their safekeeping, with restricted access. 5.6. If the Client's ticket turns out to be a winning ticket, the Agent notifies the Client of the win. Delivery of the original ticket to the Client is carried out by any method agreed by the parties, including international delivery, upon the Client's separate request submitted via the "Request ticket" form on the site, provided this does not conflict with applicable law, or the Agent otherwise assists the Client in claiming the prize in accordance with the lottery's rules and applicable US law. 5.7. If the rules of the relevant lottery require the ticket holder to appear in person to claim a prize, the Agent will assist in delivering the ticket to the Client but does not guarantee that the prize can be claimed without meeting the lottery operator's requirements. 5.8. In the event of a prize exceeding the amount set by the rules of the relevant lottery for automatic payout, the further course of action shall be determined jointly by the Client and the Agent, taking into account the requirements of the lottery operator and applicable law. 5.9. If, for reasons beyond the Agent's control (technical malfunction of the retailer's equipment, closure of ticket sales for the selected drawing, technical failure, cancellation of the drawing by the lottery operator, etc.), it is not possible to purchase the ticket, the Agent notifies the Client and refunds the amount paid or, with the Client's consent, applies it toward the next drawing. 6. PAYMENT 6.1. The Client pays the price of each selected combination of numbers (a "board") according to the rate stated on the site at the time the ticket is placed. The payment covers the cost of the lottery ticket itself and the Agent's fee for the service. 6.2. The fee under clause 6.1 does NOT include shipping of a winning ticket. When submitting a request to receive a winning ticket, the Client additionally pays the actual cost of such delivery at the carrier's rate in effect at the time of shipment. 6.3. Once the Agent has purchased the physical lottery ticket, the Instruction is deemed fulfilled, and the amount paid for the purchased ticket and the service rendered is non-refundable. 7. LIABILITY 7.1. The Agent does not guarantee a win and is not responsible for the outcome of the drawing — this is a matter of chance determined solely by the lottery operator. 7.2. The Agent is liable for loss or damage to a purchased ticket caused by its own fault, and for failing to purchase a ticket in time provided the Client paid correctly and on time. 7.3. The Client is responsible for the accuracy of the numbers selected and the information provided at registration. 7.4. The Agent is liable solely for the proper performance of the Instruction to purchase and store the ticket, and is not liable for decisions of the lottery operator, changes to lottery rules, or the postponement or cancellation of a drawing. 7.5. The parties are released from liability for failure or improper performance of their obligations under this agreement if caused by force majeure, including but not limited to: lottery terminal malfunction, power outage, natural disasters, military actions, a lottery operator's decision to cancel or postpone a drawing, and other circumstances the parties could not have foreseen or prevented. 8. TAXES 8.1. The Client understands that receiving a prize may involve tax withholding or compliance with other requirements of US law. The Agent is not responsible for any tax consequences for the Client. 9. SERVICE AVAILABILITY AND ELIGIBILITY 9.1. US-Jackpot provides its agency services only in jurisdictions where such services may be lawfully offered and where US-Jackpot lawfully offers its services. 9.2. IDENTITY VERIFICATION AND AGE 10.1. The Client confirms that they are at least 18 years old and that participating in US lotteries is not prohibited by the laws of their country of residence. 10.2. The Agent may require the Client to complete identity verification (KYC) before purchasing a ticket, before delivering a prize, or in other cases required by law or payment systems. 11. COMPLIANCE, FINANCIAL MONITORING AND SANCTIONS 11.1. The Agent may refuse to carry out, or may suspend, the Instruction if a payment system, bank, or competent government authority requires additional verification of the Client. 11.2. The Agent may refuse to carry out the Instruction for persons or countries subject to international sanctions or other legal restrictions. 11.3. The Agent may refuse to carry out the Instruction if there are reasonable grounds to believe the transaction may be related to money laundering, terrorist financing, or other illegal activity. 12. RESTRICTIONS ON USE OF THE SERVICE 12.1. The Agent may refuse to register the Client, to carry out an Instruction, or to continue providing service, in particular in the event of: suspected fraud; an attempt to use a stolen payment card; the Client registering multiple accounts; abuse of the Service's bonuses or promotional offers; use of a VPN or other means to bypass geographic or other restrictions of the Service; or violation of laws applicable to the Service's operations. 13. PERSONAL DATA 13.1. The Client consents to the processing of their personal data (full name, date of birth, country of residence, identity document) for the purposes of performing this agreement and identity verification. 14. AMENDMENTS TO THE AGREEMENT 14.1. The Agent may amend this Agreement. The new version takes effect upon its publication on the Service. In the event of material changes, the Client may be asked to re-accept the terms of the Agreement. 15. LANGUAGE OF THE AGREEMENT 15.1. If multiple language versions of this Agreement exist, the English-language version shall prevail. 16. ELECTRONIC FORM OF THE AGREEMENT 16.1. By clicking the "Register" button, the Client signs this Agreement by means of a simple electronic signature. 17. GOVERNING LAW 17.1. This agreement is governed by the laws of the jurisdiction in which the Agent is registered, unless mandatory law applicable to a specific transaction provides otherwise. By accepting these terms at registration, the Client confirms having read this agreement and fully agreeing to it.
